Booking and Payment

  • A deposit of 30% of the charter fee is required to secure the booking.
  • The remaining balance must be paid no later than 14 days before departure.
  • Failure to make payment in full by the due date may result in cancellation without refund.
  • If cancellation is made less than 7 days prior to the charter date, the deposit will be non-refundable.
  • All prices include crew, fuel limits, standard insurance, food, and wines unless otherwise stated.
  • Taxes and additional fees apply where required by law.

Cancellations and Refunds

  • Cancellations must be made in writing.
  • More than 7 days before departure: 90% refund of the total charter fee.
  • Less than 7 days before departure: No refund.
  • The company reserves the right to cancel due to weather, safety, mechanical issues, or other unforeseen circumstances.
  • In such cases, the Charterer will be offered a reschedule, an alternative cruise on the same day, or a full refund.

Weather Conditions

  • The safety of passengers and crew is the priority.
  • The vessel will not depart in unsafe weather conditions as determined by the Captain.
  • If weather prevents departure, the Charter Company may offer to reschedule, relocate, or issue a partial or full refund at its discretion.
  • A weather report will be advised a few days prior to departure from the selected departure point.
  • An alternative starting point will be notified should the weather from the selected location be unsuitable.
  • Please note that this is the Wild Atlantic Way, and there can be, or will be, swells running.

Captain and Crew Authority

  • The Captain has full authority over the operation of the vessel.
  • The Captain reserves the right to terminate the charter without refund if passengers behave recklessly, pose a danger, or disregard crew instructions.

Charterer Responsibilities

  • The Charterer must ensure all guests comply with safety instructions.
  • Guests must respect the vessel and its equipment and refrain from illegal activities.
  • The Charterer is responsible for any damage caused by them or their guests due to negligence or misconduct.
  • Children under the age of 12 must always wear a life jacket.
  • It is the responsibility of the parent or guardian to ensure supervision of the child.

Use of the Vessel

  • The vessel may only be used for lawful, recreational purposes as agreed at the time of booking.
  • Commercial filming, large events, or sub-charters require prior written approval.

Liability and Insurance

  • The Charter Company maintains standard marine liability insurance.
  • The Charterer and their guests participate entirely at their own risk.
  • The Charter Company accepts no liability for loss, injury, or damage to persons or personal property unless directly caused by proven negligence of the Charter Company or crew.

Fuel and Additional Charges

  • Unless otherwise specified, fuel costs beyond normal cruising activity are the responsibility of the Charterer.
  • No water toys are provided.
  • Fishing is not permitted except for one rod provided by the charter.

Alcohol and Drugs

  • Reasonable alcohol consumption is permitted at the Captain’s discretion.
  • Illegal drugs are strictly prohibited.
  • Violation of this term will result in immediate termination of the charter without refund and possible legal action.
  • Safety remains the priority at all times.

Governing Law

  • These Terms and Conditions are governed by the laws of the Republic of Ireland.
  • Any disputes will be subject to the exclusive jurisdiction of the courts of the Republic of Ireland.

Agreement

  • By booking and/or boarding the vessel, the Charterer acknowledges and agrees to all terms stated herein.
